Redundancy

Redundancy is a reason for losing a job. It is not dismissal and it is not unfair dismissal. However, if the process of informing and consulting can find no alternative to redundancy and the final decision is that the employment contract is to be terminated on the grounds of redundancy then the employer must follow a statutory dismissal procedure. This is set out in this section but, in summary, the employer must write to the employee setting out the reasons for the dismissal; meet with the employee to discuss the dismissal; and, where the employee requests it - hold an appeal. As with dismissals for other reasons the right to be accompanied is maintained during this process.
