This legal requirement came into the force with the Management of Heath and Safety at Work Regulations 1992 requiring that all employers must appoint one or more competent persons. An amendment in 1999 states that this person should preferably be in direct employment of the organisation.
Guidance to the Regulations describes competence in terms of 'training, knowledge and experience' .
